In order to provide our services, we collect and process personal data from our clients.  

What is personal and sensitive data?

Personal data is data which can be used to identify you. This may include your name, date of birth, address, telephone number etc.

Sensitive personal data is information related to any of the following: racial or ethnic origin, political opinions, religious beliefs, health, sexuality or sex life, offences and/or convictions.

Where will you collect my information from?

We collect our information from: self-referral forms; referrals from organisations; telephone conversations; emails and written and verbal communications and from records of any sessions.

Where will you store my data?

The record of your case will be stored in an electronic data base system accessed by Rathbone Family Mediation mediators.

Your information may also be stored in a paper file held securely and accessed by Rathbone Family Mediation.

How long will you keep my information?  

We will only store the information as long as required either by law, regulation, whilst you are a client and up to 6 months after your case is closed.

How will you use my data?

Your data will primarily be used for the purpose of providing you with a mediation service.

Sharing and disclosure to third parties

We may disclose your personal data to third parties from time to time under the following circumstances:

  • You request or authorise the disclosure of your personal details to a third party.
  • The information is disclosed as permitted by applicable law(s) and/or in order to comply with applicable law(s) (for example to comply with a search warrant or a court order).
  • The information is provided to service providers who perform functions on our behalf – hosting providers for the secure storage and transmission of your data.

Can I withhold my consent?

Yes, but Rathbone Family Mediation will not be able to provide you with a mediation service which provides you with paper and electronic information.

What is a Data Controller?

A Data Controller is someone who is responsible for your data and who must make sure that your data is processed according to the law.  For example, they are responsible for making sure that the information hold about you is accurate and that it is kept secure.  For the purposes of GDPR the Mediators are the Data Controllers.

Why might you share my personal and sensitive personal data? Who will you share it with?

We will only ever share your information with your permission, for the purposes we have stated (unless required to do so by law).

Your rights

  • You have the right to be informed of the use of your personal data
  • You have the right to access and/or require the correction or erasure of your personal data
  • You have the right to block and/or object to the processing of your personal data

Obtaining the information we hold about you

You have the right to ask for a copy of your information and to correct any inaccuracies and under the GDPR, Rathbone Family Mediation is required to respond to your request within 7 days.  If you would like a copy of the information we hold about you please contact Will Stewart.
